Following a person’s death, claims can sometimes arise in relation to the estate and any Will (or the lack of a Will).

This is called contentious probate. The claims may involve a claim for an interest in the deceased’s estate, it may be challenging the Will and/or the validity of the Will, or it could be a claim relating to a Grant of Probate already made.

One of the most common claims is an interest action. For example, this often relates to a claim under the Inheritance (Provision for Family and Dependants) Act 1975.

Claims of this type require specialist advice. There are pre-action protocols which apply to these claims.
